Employer Statement of Entrusting Work — How to Legally Work in Poland

What is the employer statement of entrusting work and how does it work in Poland? A step-by-step guide for citizens of Ukraine, Belarus, and Georgia who want to work legally in Poland.

If you are a citizen of Ukraine, Belarus, Georgia, Moldova, Armenia, or Russia, you can legally start working in Poland without waiting months for a formal work permit. The key document is the employer statement of entrusting work to a foreigner (Polish: oświadczenie o powierzeniu wykonywania pracy cudzoziemcowi).

What Is the Employer Statement of Entrusting Work?

This is a simplified employment procedure available to citizens of six specific countries. The employer registers the statement with the District Labour Office (PUP) — that is all. No months of waiting, no need to prove that no Polish candidate was available.

The procedure is available only to citizens of: Ukraine, Belarus, Georgia, Moldova, Armenia, and Russia.

Step-by-Step: How It Works

Step 1: The Employer Registers the Statement

Nexflow, as a temporary staffing agency, submits the statement through the praca.gov.pl portal or in person at the District Labour Office. The statement includes:

  • employer details and workplace location
  • worker details (first name, surname, date of birth, nationality, passport number)
  • type of contract (civil-law or employment contract)
  • job title and salary (at least the minimum wage)
  • period of work (maximum 24 months)

Registration is free of charge and takes 1 business day.

Step 2: The Labour Office Enters the Statement into the Register

The District Labour Office registers the statement and issues the employer a stamped confirmation. From this point on, the statement is a valid document confirming the legality of employment.

Step 3: You Receive a Copy of the Statement

Nexflow provides you with a copy of the registered statement. You will need it:

  • when applying for a work visa (if you do not yet have the right to enter Poland)
  • during inspections of employment legality by the State Labour Inspectorate (PIP)
  • when extending your stay or applying for a residence card

Step 4: Travel to Poland and Sign the Contract

With the statement, you can enter Poland based on:

  • Short-stay visa (C) — stays up to 90 days
  • National visa (D) — for stays exceeding 90 days
  • Visa-free travel — for citizens of Ukraine, Georgia, and Moldova (up to 90 days in the Schengen Area)

After arriving, you sign the contract with Nexflow and begin work.

How Long Can You Work Under the Statement?

Up to 24 months within the next 36-month period. After expiry, the employer can register a new statement or apply for a formal work permit on your behalf.

Your Employment Rights

A worker covered by the statement has exactly the same rights as a Polish citizen:

  • minimum wage (PLN 4,666 gross from 1 January 2026)
  • annual leave (20 or 26 days depending on seniority)
  • ZUS social insurance and access to NFZ public healthcare
  • right to sick leave (L4)
  • protection against unlawful dismissal

Nexflow registers you with ZUS from your very first day of employment and pays all contributions on your behalf.

Frequently Asked Questions

Is the employer statement the same as a work permit?

No. The statement is a fast, simplified procedure for six nationalities — no administrative decision required, no fees. A work permit (type A, B, etc.) is a separate, longer process that requires submitting an application and waiting for a decision.

Can I change employers?

The statement is tied to a specific employer. If you change employers, the new employer must register a new statement for you.

What happens after 24 months?

The employer can register a new statement. Alternatively, if you plan a longer stay in Poland, apply for a temporary residence card (karta czasowego pobytu) — ideally before your current visa or permission to stay expires.
